General Terms of Business

of Dike Verlag AG

  1. Scope of application

The following General Terms of Business (GTB), as amended at the time the order is made, apply to the business relationship between Dike Verlag AG, Weinbergstrasse 41, CH-8006, Zurich (hereafter «Dike»), and its customers. The GTB do not apply to the business relationship between Dike and book dealers or sub-distributors who are supplied directly from publishing distributors Balmer Bücherdienst AG or Verlag C.H.Beck. The GTB of the publishing distributors (www.buchzentrum.ch, www.beck.de) apply in this regard.

The customer acknowledges that the following GTB are an integral part of the contract entered into with Dike. The GTB may be amended at any time by Dike.

  1. eBooks / Download / Rights of use

eBooks that were purchased on our homepage can be downloaded in the Download area with your account information. The number of downloads from our homepage is limited to two.

The purchaser is not allowed to dublicate, disseminate, reproduce publicly or make the eBook available to the public. Single copies may be made only for private use (Art. 19 URG). The production and distribution of other copies is limited to express consent of Dike.

  1. Orders and delivery times

All orders are binding in principle. The publishing products ordered are generally delivered within one to three business days. Express deliveries requested must be notified by the customer by emailing auslieferung@dike.ch or by calling + 41 (0)44 251 58 30.

Publishing products that cannot yet be delivered will be shipped later after release along with an invoice. The customer will be notified immediately of any delivery problems. Orders of titles that can temporarily not be delivered may be cancelled at any time. There is no right of cancellation if the order can no longer be cancelled at Dike. No claim may be derived from delivery delays.

  1. Prices

All prices are inclusive of VAT at the statutory rate. We expressly reserve the right to make price adjustments. Subscriptions for the publication journals are invoiced at the end of every calendar year for the following calendar year.

  1. Payment terms

Payment must be made net within 30 days from the date of the invoice. The invoice will be enclosed with the item sent. Processing fees will be invoiced in the case of unjustified deductions and where reminders are sent. In the case of payment default, Dike is authorized to invoice late interest in the statutorily prescribed amount (Art. 104 Code of Obligations [OR]). The following credit cards are accepted as payment methods for online purchases: PostCard, MasterCard or VisaCard.

  1. Shipping costs

For publishing products (excluding journals under a subscription) the customer will be charged shipping costs in accordance with the delivery type selected by him or her.

The amount of shipping costs charged varies according to the weight of the item delivered and type of packaging used and depending on whether there are additional government duties. Dike is also authorized to charge the customer separately for additional logistics costs for special deliveries. For all deliveries abroad the additional taxes and customs duties are payable by the party making the order.

In the case of journal subscriptions, shipping costs are included in the subscription price.

  1. Retention of title

Title to the products delivered shall remain with Dike until full payment is made.

  1. Discount

A 10% discount on all web shop book titles is generally granted for online orders. In addition, the customer discount shall apply in accordance with the information in the individual customer groups.

  1. Right of return

There is a right of return in the case of wrong deliveries or production defects. The defects must be notified within 10 days from the date of the postmark, and no shipping shall be charged for replacement deliveries.

In the case of journals, claims concerning missing magazines may be made within 30 days after the relevant date on which they came out. Complaints concerning technical production defects can only be considered within 8 days of receipt of the item sent. For damage caused by mailing, claims must be made directly to the post office at the place of delivery.

  1. Cancellation of journal subscriptions

A journal subscription is taken out for an indefinite period. The contract shall initially apply to the end of the calendar year in which the subscription has been taken out and is automatically renewed for a further calendar year unless it has been cancelled within the due time in writing, by fax or by email. Cancellations for the new subscription period must be notified by October 31 of the previous year.

  1. Copyright

The contents of the Dike web pages are subject to protection under copyright law. These contents may not in any way be reproduced or reused either in whole or in excerpts without written consent. Nor is it permitted to save or duplicate images, copies or graphics from the individual web pages .

  1. Exclusion of liability for contents and external links

The contents of the Dike webpage have been carefully checked prior to their inclusion but no liability can be accepted for their completeness and accuracy. Nor, despite thoroughly checking the content, can Dike accept responsibility for the contents of direct or indirect external links. Only the operators of the linked pages are responsible for the content of those linked pages. Dike assumes no liability for direct or indirect loss or damage caused by information and contents of the linked pages.

  1. Data protection

Dike takes the privacy of its customers very seriously. Customer data is therefore collected, processed and stored by Dike exclusively in-house and is only used to execute the orders issued by the customers, to provide information in accordance with the business relationship between the customers and Dike, to meet commercial claims (credit check) and to fulfill statutory requirements. Dike customers are informed of new publications by means of bulletins and electronic newsletters. If these information services are no longer desired, you can unsubscribe to them at any time. Dike will under no circumstances sell or lease personal customer data to third parties. Personal data is only transmitted to government establishments and authorities only on the basis of and under mandatory statutory provisions. To secure personal data Dike follows the highest security standards both in technical and organizational terms. All employees are obligated to comply strictly with all relevant data protection provisions.

This website uses Google Analytics, a web analysis service of Google Inc. («Google»). Google Analytics uses what are known as ìcookiesî, text files which are saved on your computer and which enable an analysis to be made of how you use the website. The information generated by the cookie about your use of this website (including your IP address) is transferred to a Google server in the USA and saved there. Google will use this information to analyze your use of the website, in order to compile reports of the website activities for the website operators and in order to provide additional services associated with the website use and internet use. Google will also in some case transfer this information to third parties provided this is prescribed by statute or provided third parties process this data on behalf of Google. Google will in no circumstances link your IP-address with other data of Google. You can prevent the cookies from being installed by adjusting your browser software accordingly; we would, however, draw your attention to the fact that in this case you may in some cases not be able to fully use all functions of this website.   1. Place of performance, venue

Zurich shall be the place of performance and venue. The contractual relationship shall be subject exclusively to Swiss law with the exclusion of the Vienna Convention on Contracts for the International Sale of Goods of 11 April 1980. In case of conflict between the German and English version of these GTB the German version prevails.
